This Acceptable Use Policy specifies the actions prohibited by Call America, to users of the Call America IP Network. Call America reserves the right to modify the AUP at any time, effective upon posting of the modified AUP to this URL: http://www.callamericacom.com/products_services/aup.html

Illegal Use
The Call America IP Network may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

System and Network Security
Violations of system or network security are prohibited, and may result in criminal and civil liability. Call America will investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected. Examples of system or network security violations include, without limitation, the following:

  • Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
  • Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
  • Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks.
  • Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
  • Distribution of software, programs, or messages that may cause damage or annoyance to persons, data, and or computer systems. Customers that receive a notification of infection have 48 hours to secure or remove the host from the network. Hosts not timely secured or removed by customers may be blocked by Call America from accessing the network

Email Spamming (or Mail Bombing)
Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site.

Non-Email-Based Spamming
Posting the same or similar message to one or more newsgroups/ blogs/ services that are irrelevant (excessive cross-posting or multiple-posting, also known as "SPAM") is explicitly prohibited.

INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF A CALL AMERICA BUSINESS CUSTOMER OR A CUSTOMER'S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER.

Violations and Enforcement
At Call America's sole discretion, violations of any element of this AUP may result in a warning to the offender followed by suspension or termination of service if customer does not cease the violation. Call America may immediately suspend or terminate service with or without notice if Call America determines that a violation of the AUP has occurred. Call America will enforce this AUP according to the severity of the offense and violator's history of prior AUP infringements. Severe and/or repeated offenses will result in immediate termination of service. Call America is not liable for damages of any nature suffered by any customer, end-user, or any third party resulting in whole or in part from Call America exercising its rights under this AUP. Call America has no practical ability to monitor all conduct, communications, or content that might violate this AUP prior to its transmission over the Call America network but, where possible and necessary, may do so at its discretion. Therefore, Call America does not assume liability for others' violations of the AUP or failures to terminate those violations. Call America reserves the right to charge time and materials to resolve customer issues that are not resolved by the customer in a timely manner.
